CUP Condition  

Plan Commission April 16, 2026 memo attached lighting as a named condition of Phase 1 CUP approval. The condition requires submission and approval of a final lighting plan - but this was a post-approval condition, not a pre-approval study. No photometric data was in the public record before the Village Board voted on May 7-8, 2026. This is a gap in the evidentiary record.

Town of Vernon ordinances govern nuisance-level light trespass onto residential parcels within its jurisdiction. The surrounding roads (Town Line Rd, Skyline Ave, Big Bend Drive) and many neighboring homes fall under Vernon's jurisdiction. Light spillover from 80-ft poles onto Vernon residential parcels may trigger nuisance enforcement independent of the Big Bend CUP.

State Level 

Wisconsin allows municipalities to regulate outdoor lighting to limit light pollution, glare, and spillover. Standards typically

require full-cutoff fixtures, maximum foot-candle levels at property lines, and hours of operation limits. Big Bend's CUP

conditions include hours restrictions -but without a photometric study, compliance cannot be verified.
